TERMS + CONDITIONS


OVERVIEW
Sanctuary Interiors LTD is a New Zealand owned company and has been operating since 2018. These terms and conditions govern all supply of goods and services ("products") by Sanctuary Interiors Limited ("{Sanctuary Interiors Limiterd", "we, "us") to you, the purchaser of goods and services from us, including your use of the website at www.sanctuaryinteriors.co.nz ("the website"). They are effective from 01.06.2020 and will replace all earlier Sanctuary Interiors Limited terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

By visiting our site and/ or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.


AVAILIBILITY
All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop.


PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.


PRICING
All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax ("GST") unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.


DELIVERY + SHIPPING
Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

STANDARD SHIPPING
Orders are processed within one working day of the order being placed. Once processed, our standard delivery times are between 1-2 working days (within the Auckland region) or 2-3 working days (rest of New Zealand). Overnight delivery is available on request for an additional charge.
Standard shipping rates start from $5. For bulky/heavy/fragile items, or international delivery, additional shipping costs will apply.
If you're unsure, email hello@sanctuaryinteriors.co.nz for a quote. Otherwise, an estimate will be emailed to you when your order is processed.
NOTE: Due to current Covid-19 Courier delays, your order may take longer than expected.


RETURNS POLICY
At Sanctuary Interiors New Zealand we want to ensure that you love your purchase and are happy with the quality and fit. If for any reason you're not satisfied with your purchase, please return it to us within 14 days of receipt of the product/s.
Items purchased online can be returned with the accompanying returns form via courier/post to our head office address: Please email hello@sanctuaryinteriors.co.nz We endeavour to process returns within five working days.
For full price items, we will either exchange or provide a store credit, provided that the product/s are in original condition and are accompanied with their original packaging and receipt. For clothing purchased online, We will exchange or refund any full price item purchased through our website, provided the item is returned in original condition, unworn, unwashed and unaltered. For sale items, we cannot offer exchanges or refunds, unless the product is faulty.

CHANGE OF MIND
We do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully. If the goods are faulty, we will meet our obligations under the Consumer Guarantees Act to provide a remedy.


FAULTY ITEMS
Under the Consumer Guarantees Act 1993, the items you purchase from us are required to be of acceptable quality.
If you consider that an item that you have purchased is faulty, please get in touch for assessment. This can take up to five working days from the date the item is received by our team. If the item is faulty, we will either repair or replace the item, depending on the circumstances; if a repair or replacement is not available, then we will be happy to provide you with a full refund.
We are not responsible for any fault that may have arisen due to your use or care of the item if you have used the item in a way, or to an extent, that a reasonable consumer would not have used the item – this includes a failure to follow care instructions. If we find that the fault has arisen due to your use or care of the item, we are not responsible for your costs of returning the item to us to be assessed, or sending the item back to you.
If the item is faulty and we have failed to repair the fault in a reasonable length of time (after we have assessed the item), then you can either have the item fixed elsewhere (and we will be responsible for the costs) or reject the goods and return them to us for either a replacement item or a refund.
If the fault cannot be repaired or is a breach of substantial character of any of the warranties implied under the Consumer Guarantees Act 1993, then you can reject the item by returning it to us, and receive either a replacement item or a refund. If you want to reject the item, you need to do so within a reasonable time. You cannot reject the item if you have disposed of it, it has been lost or destroyed, the item was damaged after you received it, or you have attached it to or incorporated it into another item (and the item cannot be removed from the other item without being damaged).
The above is not intended to alter any rights or obligations contained in the Consumer Guarantees Act 1993.

GIFT EXCHANGES
If you are purchasing as a gift, we offer a gift exchange service so that the receiver can exchange or return within the guidelines above.

SHIPPING YOUR RETURN
Please return your product by courier, Depending on where you live, the time it may take for your exchanged product to reach you, may vary.
If you are shipping an item over $50, you should consider using a trackable shipping service or purchasing shipping insurance. We don't guarantee that we will receive your returned item.

LIABILITY LIMITATION
Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.
You agree to indemnify, defend and hold harmless Sanctuary Interiors and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


APPLICABLE LAW + JURISDICTION
Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.
Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.
Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

PRIVACY POLICY + CONFIDENTIALITY
Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.
Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).
We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.
You will need to permit us to place data files ("cookies") on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you.
We may disclose your personal information as required by law.
Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.
You can request details of your personal information that we hold, and ask us to correct it, at any time.


OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.


ERRORS, INACCURACIES + OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).


GENERAL CONDITIONS
We reserve the right to change these terms and conditions from time too time by notice, which may be in the form of a notice posted on our website at www.sanctuaryinteriors.co.nz.
If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.
Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.
We may deliver notices to you by sending them to an email address that you have notified to us.


GIFT VOUCHER CONDITIONS

Gift vouchers are valid for 12 months from date of issue. Unused values will not be refunded or attributed to any transactions after the expiry date.

Gift vouchers can be redeemed against all products only at https://www.sanctuaryinteriors.co.nz
Gift vouchers cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.
If your purchase exceeds the value of the gift voucher, balance must be paid by cash, debit or credit card.
If you return any products you have purchased using a gift voucher, the balance will be credited to you as a credit note and is to be redeemed against subsequent purchases.
Gift vouchers cannot be replaced if lost or stolen. If you suspect an unauthorised activity, immediately report this to Sanctuary Interiors via email to hello@sanctuaryinteriors.co.nz providing all details including proof of purchase, gift voucher number and a photo ID for verification purposes.
Sanctuary Interiors LTD reserves the right to cancel a gift voucher if we deem such action necessary. If so, we may either provide a replacement gift voucher of equivalent value unless we suspect fraud in relation to a gift voucher. The gift voucher remains our property.
Sanctuary interiors can vary or replace these conditions from time to time (including to introduce new fees)
